TERMS AND CONDITIONS

  1. Introduction

These Terms and Conditions explain how our services work and outline the responsibilities of both parties.

“You” or “Customer” refers to the person booking our services.
“We”, “us” or “our” refers to Shift Xpress Logistics Ltd.

By confirming a booking, you confirm that you have read, understood and accepted these Terms and Conditions.

Our aim is to provide a smooth, professional and stress-free moving experience with full transparency.

  1. Definitions
  • Goods / Items refer to all property handled, moved or stored by us, including boxes, cartons, furniture, appliances and personal belongings.
  • An Item means either the entire contents of one box or container, or a single object handled by us.
  1. Our Quotation
  • All quotations are based on the information provided by the Customer at the time of booking and include standard removal liability unless stated otherwise.
  • Quotations exclude customs duties, government fees, parking charges, parking fines or third-party costs unless agreed.
  • Prices may change if access, parking, carry distance, stairs, lift availability, working hours or item quantities differ from what was advised.
  1. Work Not Included

The following services are not included:

  • Assembly or disassembly of new flat-pack furniture
  • Disassembly or reassembly of any furniture that cannot be safely dismantled without forcing, altering, or modifying it
    (we will only dismantle and reassemble existing furniture where this can be done safely and as designed by the manufacturer)
  • Disconnecting or reconnecting gas, electricity, or water supplies
  • Removing, installing, or altering floor coverings
  • Modifying doors, windows, or any other structural or permanently fixed elements of the property
  • Drilling, fixing, mounting, or attaching items to walls or ceilings
  1. Customer Responsibilities

The Customer must:

  • Ensure items are ready, packed and accessible
  • Empty, defrost and clean fridges and freezers
  • Provide accurate access, stair, lift and parking information
  • Ensure lifts are operational where applicable
  • Separate and remove valuables, documents and keys
  • Inform us of damaged or fragile items in advance

Declared Value of Goods

  • The Customer is required to provide an accurate estimate of the total value of all goods to be moved and/or stored prior to the commencement of the service.
  • If no value is declared, our liability will be limited in accordance with the Liability clause of these Terms and Conditions.
  • Where a value is declared, it must reflect the current market value of the goods, taking into account age, condition, and depreciation.
  • If it is subsequently established that the declared value is lower than the actual value of the goods, our liability will be reduced proportionately.
  • We reserve the right to request a detailed valuation or inventory of goods where appropriate.
  1. Items Not Accepted

For safety and legal reasons, the following items cannot be transported:

  • Hazardous or flammable goods (including paints, solvents, and chemicals)
  • Cash, jewellery, watches, keys, deeds, securities, or other valuables
  • Passports, legal documents, or important personal records
  • Perishable or contaminated items
  • Animals
  • Goods that require controlled or specialist environments

If you are unsure about any items, please let us know in advance and we’ll be happy to advise.

  1. Payment Terms
  • A 30% deposit is required to confirm your booking.
  • The remaining 70% balance must be paid before unloading begins.
  • Our crew will not unload goods until payment is received in full.

Late Payment & Recovery of Costs

If payment is not received by the due date, we reserve the right to:

  • Charge interest at 8% per annum above the Bank of England base rate, calculated daily
  • Apply a reasonable administration fee for late payments or reminders
  • Recover costs incurred in collecting the debt (including legal and agency fees)
  • Suspend or delay services, including delivery or release of goods

All outstanding amounts must be paid in full before any goods are delivered or released.

  1. Waiting Time

Waiting time begins from the agreed arrival time if the crew cannot start work due to Customer-related delays, including:

  • Customer not being ready
  • Items not fully packed (unless packing service booked)
  • Lack of property access
  • Parking not secured

No waiting charges apply before 1:00 PM where the job is already loaded but unloading is delayed outside our control.

After 1:00 PM:

  • £60 per hour per vehicle within the M25
  • £70 per hour per vehicle outside the M25
  1. Parking & Access
  • Parking must be legal and within 20 metres of the entrance
  • Parking must not require crossing a public road
  • Any parking fines incurred will be added to the final balance

If parking is not secured:

  • An advance charge of £80 per vehicle per property may apply
  • This will be refunded within 4 weeks if unused
  1. Long Carry Distance
  • The quotation includes up to 20 metres carry distance
  • Beyond this:
    • £10 per crew member per additional 10 metres (or part thereof)
  1. Stairs & Lift Access
  • Prices assume a working lift
  • If no lift is available:
    • No charge for first floor
    • From level 2 upwards: £25 per crew member per floor
  1. Loft Items

Items removed from lofts will not be placed back into lofts at delivery and will instead be placed in the nearest accessible room.

  1. Utilities & Appliances
  • We do not work with gas, electricity, or water systems
  • Disconnection/reconnection is the Customer’s responsibility
  • Any assistance is at the Customer’s risk
  1. Flat-Pack Furniture & Unpacking
  • Flat-pack assembly and unpacking are not included
  • These services are charged separately at an agreed hourly rate
  1. Valuables, Documents & Keys
  • We do not accept responsibility for valuables, documents, or keys
  • These must be transported separately
  • Customers must check all packing materials carefully
  1. Pre-Existing Damage

Items already damaged or weakened will be handled with care, but we cannot accept liability for unavoidable damage due to their condition.

  1. Restricted Access & Oversized Items
  • We do not force items or modify structures
  • Forced placement is only done with written email consent
  • All resulting damage is accepted by the Customer
  1. Condition Records

Photos or videos may be taken before work begins for evidential and insurance purposes.

  1. Liability
  • Liability is limited to Goods in Transit insurance (currently up to £10,000 per vehicle) unless agreed otherwise
  • Compensation is based on current market value, not purchase price
  • For sets or pairs, liability applies only to the individual item
  • No compensation is provided for sentimental value

In all cases, liability is limited to the lesser of:

  • Cost of repair
  • Current market value

We are only liable where loss or damage is caused by negligence or breach of contract.

We hold Public Liability Insurance up to £1,000,000.

  1. Exclusions

We are not liable for:

  • Wear and tear
  • Pre-existing damage
  • Sentimental value
  • Indirect or consequential losses
  1. Claims

Claims must be reported:

  • At delivery, or
  • Within 5 days in writing
  1.  

 Storage Facility

  • Storage is available and priced based on unit size
  • Flexible durations available

Items Not Accepted for Storage

  • Perishable goods
  • Plants
  • Hazardous or flammable materials
  • Goods requiring controlled environments

Charges & Terms

  • Charges include removal into storage + storage fees
  • Storage beyond 4 weeks is payable every 4 weeks in advance
  • 14 days’ written notice required for:
    • Extensions
    • Delivery from storage
  • Goods are not insured unless agreed in writing
  1. Lien

Right to Retain, Sell or Dispose of Goods

  • We may retain goods until all charges are paid
  • If unpaid, we may issue a 14-day notice

If still unpaid, we may:

  • Continue storage and charge additional fees
  • Sell or dispose of goods

Proceeds Distribution

Outstanding charges

  1. Storage/admin costs
  2. Sale/legal costs
  • Any remaining balance is returned (no interest)
  • If insufficient, Customer remains liable

We are not responsible for loss or depreciation from such sale.

Abandoned goods may be disposed of after reasonable contact attempts.

  1. Disputes

Disputes may be referred to arbitration by mutual agreement.

  1. Force Majeure

We are not liable for events beyond our reasonable control.

  1. Subcontracting

We may use trusted subcontractors. These Terms remain fully applicable.

  1. Governing Law

These Terms are governed by the laws of England and Wales.

  1. Acknowledgement

By confirming a booking, the Customer confirms full acceptance of these Terms and Conditions.
